These Terms and Conditions govern your use of the GrowWithDat website and any web design, SEO, or related services provided by Dat, an independent Los Angeles web designer operating under the GrowWithDat brand. By accessing this website or engaging Dat for any service, you confirm that you have read, understood, and agreed to these terms in full.

Who These Terms Apply To

These terms apply to all visitors, prospective clients, and active clients who access the GrowWithDat website at growwithdat.com or enter into any service agreement with Dat for web design, SEO, branding, hosting, or any other digital service offered under the GrowWithDat name.

Services Provided

GrowWithDat offers the following professional services to local businesses and entrepreneurs primarily across Los Angeles and the greater LA area:

  • Custom WordPress website design and development
  • Local SEO optimization and content strategy
  • Website hosting, security, and ongoing technical management
  • Graphic design and brand identity development
  • WooCommerce development and e-commerce solutions
  • Website speed optimization and Core Web Vitals improvements

All services are performed personally by Dat. The specific scope, timeline, deliverables, and pricing for each project are agreed upon before any work begins and outlined in a written project proposal or service agreement.

Project Agreements and Scope of Work

Every project begins with a clear written agreement that defines the scope of work, timeline, payment terms, and deliverables. Any work requested beyond the agreed scope — including additional pages, features, design revisions beyond the included rounds, or new functionality — will be treated as a separate request and quoted accordingly. GrowWithDat reserves the right to decline any additional requests that fall outside the original agreement without prior renegotiation.

Payments and Fees

Payment terms are outlined in each individual project proposal. In general the following applies:

  • A deposit is required before any design or development work begins
  • Remaining balances are due upon project completion or as outlined in the payment schedule
  • Ongoing services such as hosting, maintenance, and SEO retainers are billed on a monthly basis
  • All payments are due within the timeframe stated on the invoice
  • Late payments may result in a pause of active work until the outstanding balance is settled
  • Deposits are non-refundable once work has commenced

Pricing is communicated transparently upfront. There are no hidden fees, surprise charges, or inflated quotes. If your project requirements change, updated pricing will be discussed and agreed upon before any additional work is undertaken.

Revisions and Design Changes

Each project includes a defined number of revision rounds as stated in the project proposal. Revisions are understood to mean minor adjustments to existing design elements — such as color, text, or layout tweaks — and do not include complete redesigns or changes to the agreed scope. Requests that go beyond the included revisions will be assessed and quoted separately.

Client Responsibilities

A successful project depends on clear and timely collaboration. As a client you agree to:

  • Provide all required content, images, logos, and materials within the agreed timeframe
  • Give clear and consolidated feedback during revision rounds
  • Make payments according to the agreed schedule
  • Respond to communications within a reasonable timeframe to avoid project delays
  • Ensure that any content, images, or materials provided do not infringe on the intellectual property rights of any third party

Delays caused by late content delivery, slow feedback, or missed communication from the client side may affect the project timeline. GrowWithDat cannot be held responsible for deadline overruns that result from client-side delays.

Intellectual Property and Ownership

Upon receipt of final payment in full, the client receives full ownership of the completed website design and all custom assets created specifically for their project. Until final payment is received, all work remains the intellectual property of GrowWithDat.

Third-party assets used in the project — including premium WordPress themes, plugins, stock photography, and licensed fonts — remain subject to their respective license agreements. GrowWithDat is not responsible for ensuring continued licensing compliance for third-party assets after project handover.

GrowWithDat reserves the right to display completed work in a portfolio, case studies, or promotional materials unless the client has specifically requested confidentiality in writing prior to project commencement.

Hosting and Maintenance Services

Where GrowWithDat provides ongoing hosting, security monitoring, or website maintenance services, the following terms apply:

  • Services are billed monthly and begin on the date the service agreement is activated
  • Either party may terminate ongoing services with 30 days written notice
  • GrowWithDat performs regular backups, security scans, and software updates as part of maintenance packages
  • While every reasonable effort is made to maintain uptime and security, GrowWithDat cannot guarantee 100% uptime or be held liable for server outages caused by third-party hosting providers
  • Upon cancellation of hosting or maintenance services, the client is responsible for migrating their website to a new provider

SEO and Performance Results

GrowWithDat provides SEO services based on current best practices including keyword research, on-page optimization, content strategy, technical SEO, and link building. While every effort is made to improve search rankings and organic visibility, GrowWithDat cannot and does not guarantee specific ranking positions, traffic volumes, or revenue outcomes. Search engine algorithms are controlled by third parties — primarily Google — and are subject to change at any time without notice. SEO results vary based on competition, market conditions, website history, and content quality.

Third-Party Platforms and Plugins

Many web design projects involve third-party platforms, plugins, themes, and integrations such as WordPress, WooCommerce, Rank Math, FlyingPress, and others. GrowWithDat is not affiliated with or responsible for the performance, availability, pricing changes, or policy updates of any third-party product or service. Any issues arising from changes made by third-party platform providers after project handover are outside the scope of GrowWithDat’s responsibility unless covered under an active maintenance agreement.

Limitation of Liability

Dat provides all services in good faith and to the highest professional standard. However, to the fullest extent permitted by applicable law, Dat and GrowWithDat shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this website or any service provided — including but not limited to loss of revenue, loss of data, loss of business opportunity, or damage to reputation. GrowWithDat’s total liability in any circumstance shall not exceed the total amount paid by the client for the specific service in question.

Confidentiality

Any sensitive business information shared by a client during the course of a project — including business strategies, financial data, customer information, or proprietary processes — will be treated as strictly confidential. GrowWithDat will not disclose, share, or use such information for any purpose beyond delivering the agreed services.

Website Use and Acceptable Conduct

By using this website you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorized access to any part of the website or its underlying systems
  • Submit false, misleading, or fraudulent information through any contact form or communication channel
  • Copy, reproduce, or redistribute any content from this website without prior written permission from GrowWithDat

Governing Law

These Terms and Conditions are governed by the laws of the State of California. Any disputes arising from these terms or from any service agreement with GrowWithDat shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.
